Variances.

It is inevitable that a small portion of wastes cannot be treated to fully comply with the waste form requirements of this chapter consistent with the ALARA philosophy of chapter 246-220 WAC. A waste disposal site operator may apply to the department for a variance provided:

(1) The variance requested is not for a continuing process or waste stream;

(2) An equivalent or greater degree of protection is provided by the proposed alternative; and

(3) All reasonable methods of complying with the existing requirement have been considered.
