Purpose: Amend recreational fishing rules for Mill Pond in Pend Oreille County.
Citation of Existing Rules Affected by this Order: Repealing WAC 220-312-05000D; and amending WAC 220-312-050.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This emergency rule is needed to remove the daily limit for nonnative fish in Mill Pond because the pond will be removed as a mitigation measure for relicensing of Boundary Dam (Federal Energy Regulatory Commission No. 2144) beginning in summer of 2017. The reservoir fish community is largely composed of nonnative fish. Lifting restrictions will provide enhanced angling opportunity for nonnative fish in Mill Pond prior to dam removal. There is insufficient time to adopt permanent rules.

WAC 220-312-05000D Freshwater exceptions to statewide rules—Eastside.
Notwithstanding the provisions of WAC 220-312-050, effective April 22 through July 16, 2017, the following rules apply in Mill Pond (Pend Oreille County):
(1) Brook, Brown, Rainbow Trout and Burbot - No minimum size or daily limit.
(2) Other game fish – Statewide minimum size and daily limit.
REPEALER
The following section of the Washington Administrative Code is repealed effective July 17, 2017:
