EMERGENCY RULES

Effective Date of Rule: Immediately upon filing.
Purpose: Amend recreational angling gear regulation for coastal marine areas.
Citation of Rules Affected by this Order: Amending WAC 220-310-110.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, 77.12.045, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This emergency rule is needed because the department is in the process of adopting permanent rules for coastal bottomfish and halibut fisheries angling gear requirements. This rule conforms to federal action taken by the National Marine Fisheries Service. The agreed-to management plan is interim until permanent rules take effect. There is insufficient time to adopt permanent rules.

WAC 220-310-11000B Angling gear—Lawful and unlawful acts.
Notwithstanding the provisions of WAC 220-310-110, effective immediately:
In Catch Record Card Areas, 1 through 13: It is unlawful for any person to take, fish for, or possess bottomfish or halibut taken for personal use, to fail to have onboard the vessel a fish descending or fish recompression device, rigged for immediate use, and capable of rapidly returning fish to depth of capture.
