     Effective Date of Rule: April 24, 2013, 12:01 a.m.

     Purpose: Amend recreational fishing rules.

     Citation of Existing Rules Affected by this Order: Repealing WAC 232-28-61900T; and amending WAC 232-28-619.

     Statutory Authority for Adoption: RCW 77.12.047 and 77.04.020.

     Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.

     Reasons for this Finding: This emergency rule is necessary to ensure a safe and successful youth fishing event. Five thousand trout will be planted three days prior to the event to acclimate them and ensure they bite well. On April 27, 2013, preregistered kids will be allowed to fish during the event. There is insufficient time to adopt permanent rules.

NEW SECTION
WAC 232-28-61900T   Exceptions to statewide rules -- Sarg Hubbard Park Pond (Reflection Pond).   Notwithstanding the provisions of WAC 232-28-619, effective 12:01 a.m. April 24, through 4:00 p.m. April 27, 2013, it is unlawful to fish in Sarg Hubbard Park Pond, except as provided in the sections below:

     (a) Open to fishing 9:00 a.m. to 4:00 p.m. April 27, 2013, by juvenile anglers participating in the Yakima Greenway Association's "Kids' Fish-In" event.

     (b) The daily limit is reduced to two trout during the youth fishing event.

     The following section of the Washington Administrative Code is repealed effective 4:01 p.m. April 27, 2013:
