     Title of Rule and Other Identifying Information: WAC 246-847-175, repeal delegation of authority to initiate investigations, occupational therapists.

NOTICE

     THIS RULE IS BEING PROPOSED UNDER AN EXPEDITED RULE-MAKING PROCESS THAT WILL ELIMINATE THE NEED FOR THE AGENCY TO HOLD PUBLIC HEARINGS, PREPARE A SMALL BUSINESS ECONOMIC IMPACT STATEMENT, OR PROVIDE RESPONSES TO THE CRITERIA FOR A SIGNIFICANT LEGISLATIVE RULE.      Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: The occupational therapy practice board (board) intends to repeal WAC 246-847-175. This rule is not necessary because the board has statutory authority to delegate the decision to initiate investigations to a panel.

     Reasons Supporting Proposal: RCW 18.130.050(18) authorizes the disciplining authority to establish panels with three or more members to perform any duty or authority within its jurisdiction. The board delegates authority to initiate investigations to a panel based on this statute. For this reason, these rules are not required. The board believes the expedited rule-making process is appropriate because the rules only pertain to internal governmental actions.

     Statutory Authority for Adoption: RCW 18.130.050 and 18.59.130.

     Statute Being Implemented: RCW 18.130.050 and 18.130.080.

     Rule is not necessitated by federal law, federal or state court decision.
