     Changes Other than Editing from Proposed to Adopted Version: Changes, if any, from the text of the proposed rule and reasons for difference:

WAC 232-12-045 Hunting equipment restrictions.

     Under subsection (2), change the language to read the following: (2) It is unlawful to use radio-telemetry equipment to locate and hunt wildlife with transmitters attached to them.

     This change is based on public comment and interest in providing safety for finding senior or disabled hunting partners.

WAC 232-28-295 Landowner hunting permits.

     Under 2008 4-O Cattle Company Landowner Hunting Permits:

▪	Adjusted season dates for all permits to ensure good hunter distribution.
▪	Added one "Any Bull" tag, for a total of two. This will help mitigate the elk damage to crops as well as help the landowner cover the cost of administering public hunts on the ranch.
▪	Redistributed antlerless permits in A, B, and C hunts and eliminated hunt D to reduce impacts on late season elk that migrate onto the property from surrounding GMUs while still providing elk harassment.

     Under 2008 4-O Cattle Company Special Hunting Permits:

▪	Adjusted season dates for all permits to ensure good hunter distribution.
▪	Reduced antlerless permits in hunts A - F and eliminated hunt J (total reduction from sixty-five to thirty-two) to reduce impacts on late season elk that migrate onto the property from surrounding GMUs while still providing elk harassment.

     Under 2008 Silver Dollar Association Landowner Hunting Permits:

▪	Reduced antlerless quota from fifteen to eight per negotiated agreement with the cooperator.

     Under 2008 Silver Dollar Special Hunting Permits:

▪	Changed "any elk" permits from youth and persons with disabilities to just youth hunters. This was done through negotiations with the cooperator to address their desire to provide hunting opportunity for youth. The total number of "any elk" permits did not change.
▪	Decreased total "antlerless" permits from fifteen to eight per negotiated agreement with the cooperator.

     Under 2008 Blackrock Ranches Landowner Hunting Permits:

▪	Reduced antlerless quota from eight to six per negotiated agreement with the cooperator.

     Under 2008 Blackrock Special Hunting Permits:

▪	Decreased total "antlerless" permits from eight to six per negotiated agreement with the cooperator.

WAC 232-28-337 Deer and elk area descriptions.

     Under Elk Area 6012 Tri Valley, add the following change:

     Elk Area No. 6012 Tri Valley (Grays Harbor and Mason counties): Those portions of GMUs 648 (Wynoochee) and 651 (Satsop) within one mile of Brady-Matlock Road from State Highway 12 north to the junction with Schaefer State Park Road (east Satsop Road) and all lands within one mile of Wynoochee Valley Road from State Highway 12 north to the junction with Cougar Smith Road, and all lands within one mile of Wishkah Valley Road from north Aberdeen city limit to mile post 16 ((to the junction with Wishkah-East Hoquiam Road)) and all lands within 2 miles north of SR 12 between the Satsop River and Schouweiler and Hurd roads and then a line north from the end of Hurd Road to a point 2 miles north of SR 12.

     This change slightly expands the elk area to address new damage concerns.

WAC 232-28-342 2006-07, 2007-08, 2008-09 Small game seasons.

     Under Wild Turkey Seasons:

▪	Create an early fall "beardless only" season in GMUs 105-124 with a bag limit of two.
	Rationale: This is a population reduction proposal to address field staff requests to reduce turkey populations in GMUs that experience a high frequency of nuisance and damage complaints. The season timing is such that hunters should have access to hunting on both private and public lands while maintaining a season that has minimal overlap with other hunting opportunities (e.g., muzzleloader deer and elk).
▪	Early Fall General Season: Remove GMU 124 (which has been added to the beardless only season); add GMUs 127, 130, and 133 (127 and 133 were previously permit only).
	Rationale: GMU 124 was included in the beardless season due to nuisance and damage concerns. Population levels in GMUs 127-133 are high enough, as indicated by harvest trends, to allow additional recreational opportunity.
▪	Early Fall Permit Season: Remove GMUs 127 and 133.
	Rationale: GMUs 127 and 133 were added to the general season.
▪	Bag Limits: List bag limits under each season instead of in a dedicated bag limit section.
	Rationale: Bag limits were included with each season to provide clarity.

     Under mourning dove falconry seasons, change season dates from Sept. 1-15 and Oct. 1- Dec. 16 to Sept. 1- Dec. 16. This change is necessary because of federal rules and revisions to the September gun season, to provide additional opportunity for falconers when the majority of mourning doves are in Washington.

WAC 232-28-351 2006-2008 Deer general seasons and definitions.

     Under Modern Firearm, Late Buck Hunts, change the reference to "Advanced Hunter Education (AHE) Master Hunter Season" to "Master Hunter Season." This is consistent with recent commission policy and rule change of the program's title.

WAC 232-28-352 2006-2008 Elk general seasons and definitions.

▪	Under Bag Limit add the following language "Any combination of seasons, tags, and permits set by the fish and wildlife commission will not exceed a maximum of two (2) elk per hunter during the license year." This language has been added to be consistent with public interest related to equitable harvest of elk among all elk hunters.
▪	Remove all references to "Advanced Hunter Education" (AHE) and replace with "Master Hunter." This is consistent with recent commission policy and rule change of the program's title.

WAC 232-28-295   Landowner hunting permits.   A landowner may enter into a contract with the department and establish boundaries and other requirements for hunter access consistent with commission policy.

Hunters must possess both an access permit from the landowner and a hunting permit from the department when hunting on lands and for species covered under contract.

(1) Buckrun

Buckrun is located in Grant County, near the town of Wilson Creek. A legal description of the property has been filed with the county and is in the contract between Buckrun and the department.

Hunting on Buckrun is managed for a quality experience by scheduling hunt dates and keeping the number of hunters in the field low. Hunters with limited flexibility for hunt dates may experience scheduling problems. Hunters can generally expect one day hunts with written authorization from the Buckrun manager. All hunters must check in and out on hunt day. Schedule hunts in advance by calling 509-345-2577.

Deer

Elk Area No. 6012 Tri Valley (Grays Harbor and Mason counties): Those portions of GMUs 648 (Wynoochee) and 651 (Satsop) within one mile of Brady-Matlock Road from State Highway 12 north to the junction with Schaefer State Park Road (east Satsop Road) and all lands within one mile of Wynoochee Valley Road from State Highway 12 north to the junction with Cougar Smith Road, and all lands within one mile of Wishkah Valley Road from north Aberdeen city limit to ((the junction with Wishkah-East Hoquiam Road)) mile post 16 and all lands within 2 miles north of SR 12 between the Satsop River and Schouweiler and Hurd roads and then a line north from the end of Hurd Road to a point 2 miles north of SR 12.
