INTERPRETIVE AND POLICY STATEMENT

     In accordance with RCW 34.05.230(12), following are the policy and interpretive statements issued by the department regarding the insurance services division policies.

     New Policy 5.18 Adjudicating Eligibility for Compensation Benefits - Valid Job Offers after the Worker is Found Eligible for Plan Development.

     This is a new policy and became effective January 1, 2008. This interim policy provides department staff with guidance and applies when determining a worker's eligibility for compensation benefits (wage replacement) when the chargeable employer offers the worker a job (not the job of injury) after plan development services are approved.

     New Policy 6.50 Determining the Validity of a Job Offered by the Employer of Record.

     This is a new policy and became effective January 1, 2008. This interim policy provides guidance to department staff and applies when a worker disputes a vocational determination because the job offered by the employer is not valid.

     New Policy 6.47 Approving or Denying a Vocational Rehabilitation Plan - Option 2 Benefits.

     This is a new policy and became effective January 1, 2008. This interim policy provides guidance to department staff and applies when a vocational rehabilitation plan or option 2 election form is received by the department.

     New Policy 6.46 Approving or Denying Plan Development Services after January 1, 2008.

     This is a new policy and became effective January 1, 2008. This interim policy provides claim staff with guidance when the vocational rehabilitation provider recommends further vocational services are both necessary and likely to enable the worker to become employable at gainful employment.

     New Policy 6.45 Authorizing Vocational Assessment Services.

     This is a new policy and became effective January 1, 2008. This interim policy provides guidance to department staff and applies when authorizing vocational assessment services under a state fund claim or a claim against a bankrupt self-insured employer.
