EMERGENCY RULES

[ Order 08-27 -- Filed February 21, 2008, 10:59 a.m. , effective March 1, 2008 ]


     Effective Date of Rule: March 1, 2008.

     Purpose: Amend fishing rules.

     Citation of Existing Rules Affected by this Order: Repealing WAC 232-28-61900C; and amending WAC 232-28-619.

     Statutory Authority for Adoption: RCW 77.12.047.

     Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.

     Reasons for this Finding: The Washington fish and wildlife commission has approved a regulation change beginning May 1, 2008, to change the opening date for these lakes from the last Saturday in April to March 1. An emergency regulation is necessary to allow for increased angling opportunity prior to the May release of the 2008/2009 "Fishing in Washington" rules pamphlet. There is insufficient time to promulgate permanent rules.

NEW SECTION
WAC 232-28-61900C   Exceptions to statewide rules -- Downs, Liberty and Medical lakes (Spokane County).   (1) Notwithstanding the provisions of WAC 232-28-619, effective March 1 through April 30, 2008, a person may fish in the following waters:

     (a) Downs Lake

     (b) Liberty Lake

     (c) Medical Lake

     (2) All other statewide rules remain in effect.

REPEALER


     The following section of the Washington Administrative Code is repealed, effective May 1, 2008:


WAC 232-28-61900C Exceptions to statewide rules -- Downs, Liberty and Medical lakes (Spokane County).
