PREPROPOSAL STATEMENT OF INQUIRY

STATE BOARD OF EDUCATION

     Subject of Possible Rule Making: WAC 180-24-410 and 180-24-415, relating to granting remote and necessary status designation to small school plants in school districts.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: Section 502 (d)(e), Part V, chapter 7, Laws of 2001, State Operating Budget Act.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The basic policy of the state board is that the identified factors for decision-making consideration be treated equally, none to have inherently more weight than another. One factor has been given special weight contrary to the underlying policy philosophy.

     Process for Developing New Rule:       Negotiated rule making, early solicitation of public comments and recommendations respecting new, amended or repealed rules, and consideration of the comments and recommendations in the course of drafting rules.
