EMERGENCY RULES
FISH AND WILDLIFE
Date of Adoption: August 22, 2001.
Purpose: Commercial fishing rules.
Citation of Existing Rules Affected by this Order: Repealing WAC 220-32-05100F; and amending WAC 220-32-051.
Statutory Authority for Adoption: RCW 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: Sets first two weeks of tribal commercial fishing. Allows commercial sale from platform and hook and line fishery. Allows sale of fish caught in the Klickitat River to be sold when the Klickitat River is open. Harvestable numbers of salmon are available. Impacts on ESA-listed sockeye are expected to be within the guidelines of the 2001 fall management agreement and the biological opinion. Consistent with compact action of August 17, 2001. Conforms state rules with tribal rules. There is insufficient time to promulgate permanent regulations.
