What standards must the department apply to contracted and noncontracted service providers and vendors when the department has identified an overpayment to the provider or vendor?
(1) RCW 43.20B.675
provides that all vendors have the right to request a hearing if they have a bona fide overpayment dispute. The department must offer a prehearing conference to all clients and vendors that request an administrative hearing.
(2) Contracted and noncontracted service providers may seek dispute resolution through these rules, under the Administrative Procedure Act and RCW 43.20B.675
, with respect to overpayments. However, the following limitations apply:
(a) The right of vendors to seek an administrative hearing to contest alleged overpayments applies only to overpayments for goods or services provided on or after July 1, 1998.
(b) These procedures do not create a right to a hearing where no dispute right previously existed except as provided in RCW 43.20B.675
(c) These rules limit disputes for foster family and child day care providers to alleged overpayments. Homes and facilities licensed under chapter 74.15
RCW may appeal adverse licensing actions under the provisions of chapter 388-148
WAC, as applicable.
